Before: MERRITT and MARTIN, Circuit Judges; and PHILLIPS, Senior Circuit Judges. Order Dr. Hugh J. Gunne appeals the denial of his habeas corpus petition alleging that he was denied dur process because his state conviction was obtained through the prosecution's knowing use of perjured testimony. Gunne was convicted by a Michigan Recorder's Court jury for conspiracy to commit first degree murder and assault with intent to kill. Gunne was sentenced to mandatory life in prison, and twenty-five to fifty years, respectively.The Michigan Court of Appeals reversed Gunne's conviction and ordered a new trial. However, after a rehearing requested by the state, the Court of Appeals affirmed the conviction. On May 9, 1977, the Michigan Supreme Court denied leave to appeal. On May 30, 1979, the District Court denied Gunne's habeas petition, based on a magistrate's recommendation.
